Colorado Misdemeanor Traffic Offense Law

Getting a traffic ticket in the State of Colorado is a costly affair. In Colorado, although there are some traffic related felonies recognized under Colorado law, most, but not all, serious traffic violations are classified as misdemeanor traffic offenses.  In addition to the fines and penalty points applicable to nearly all traffic violation convictions, a conviction of a traffic offense may result in driver’s license suspension or revocation, community service, classes and counseling, and/or jail time.

If you are pulled over while driving and issued a citation, you need a zealous traffic violations attorney in Colorado by your side when you go to traffic court.  An experienced attorney like Ross Koplin can defend you in court, challenge evidence presented against you, and safeguard your individual rights.

Serious traffic related misdemeanors, and misdemeanor traffic offenses, include:

  • Speeding Twenty-Five Miles Per Hour Above the Speed Limit or Engaging in an Exhibition of Speed Contest
  • Careless/Reckless Driving
  • DUI/DWAI Charges
  • Driving With No Proof of Insurance
  • Driving Without a License

Misdemeanor traffic offense tickets are divided into two classes. Class One Traffic Offense Tickets are the most serious misdemeanor traffic offenses. Penalties may include imprisonment from ten (10) days up to one year. Sentences to community service, in-home detention, or to classes of instruction may also be applicable. Fines for Class One Traffic Offenses may be from $300 to $1,000. However, these fines may be increased under Colorado law and additional court costs and surcharges are normally applicable. The Judge in the applicable Court may impose both jail and a fine.

Class Two Traffic Offense Tickets are misdemeanor traffic offenses somewhat less serious than Class One Traffic Offenses. Penalties upon conviction may include imprisonment from ten (10) days up to ninety (90) days. Sentences to community service, in-home detention, or to classes of instruction may also be applicable. Fines for Class One Traffic Offenses may be from $150 to $300. However, fines may under certain circumstances be increased under Colorado law and additional court costs and surcharges are normally applicable. The Judge in the applicable Court may impose both jail and fines.
